This trial idea is pretty cool - probably not appropriate for horror games (unless you went for an incredibly surreal trial, that would fill in none of the backstory for the 'real' horrors out there for the still-living PC's), but very cool for fantasy...heck, it'd be downright amazing in a lot of superhero games!
A logical way for Ulterior-Motive Man to meet the Living Tribunal! ...perhaps with a way to not just decide whether you go 'up or down', but perhaps if you actually come back to life (it would explain the ease of resurrection in comic books).
